 4/19/13 - BREAKING: Wagoner doctors arrested on drug charges [Kokomo Tribune, Ind.]

April 19KOKOMO Criminal charges were filed against the four doctors affiliated with the Wagoner Medical Center in Kokomo and Burlington Friday by the Howard County Prosecutor's office.

Kokomo Police, assisted by the Howard County Sheriff's Department, arrested Dr. Don Wagoner, Dr. Marilyn Wagoner, Dr. William Terpstra, and physician assistants, Gary Hartman, Thomas Hewitt, nurse Linda Richards and office manager Michelle Wagoner. Dr. Robert Brewer and Physician Assistant John Thomas were charged but not arrested.

Prosecutor Mark McCann filed a total of 95 felony charges against the nine employees following an "intense" investigation by the Kokomo Police Department, Howard County Drug Task Force, Drug Enforcement Agency, FBI and the Indiana office of the Attorney General, Medicaid Fraud Control Unit.

Bond was set at $1 million, cash only for Dr. Don Wagoner, Dr. Marilyn Wagoner and Dr. Terpstra. Cash only bonds of $75,000 was set for the other six employees.

Dr. Don Wagoner was charged with: Three class A felony counts of dealing in narcotic drugs, dealing in Schedule 3 controlled substances and dealing in Schedule 4 controlled substances; four class B felony counts of dealing in a Schedule 3 controlled substance; five Class C felony counts of dealing in a Schedule 4 controlled substance; conspiracy to commit dealing in a narcotic drug and controlled substances.

Dr. Marilyn Wagoner was charged with six counts of dealing in a narcotic drug, all Class B felonies; five Class B felony counts of dealing in a Schedule 3 controlled substance; five Class C felony counts of dealing in a Schedule 4 controlled substance and felony counts of conspiracy to commit dealing in a narcotic drug and controlled substances.

Dr. Terpstra is charged with eight Class B felony counts of dealing in a narcotic drug; six counts of Class B felony dealing in a Schedule 3 controlled substance; seven Class C felony counts of dealing in a Schedule 4 controlled substance; and felony counts of conspiracy to commit dealing in a narcotic drug and controlled substances.

Dr. Brewer is charged with one Class B felony count of dealing in a narcotic drug and a Class C felony count of dealing in a Schedule 4 controlled substance.

Earlier this year the Indiana Attorney General, Medicaid Fraud Unit, filed administrative licensing complaints with the Indiana Medical Licensing Board against Dr. Donald Wagoner and Dr. Marilyn Wagoner.

Both signed a voluntary agreement on March 27 prohibiting them from prescribing controlled substances, pending action by the Medical Licensing Board.

The state licensing board is scheduled to review the petitions against Dr. Terpstra and Dr. Brewer on April 25 and against the Wagoners on June 27.
